A P J Abdul Kalam becomes 12th President of India
New Delhi,Wednesday, July 24, 2002: Architect of India's missile programme A P J Abdul Kalam on Thursday took over as the 12th President and made a strong plea for a "focused action" to combat cross-border terrorism and internal conflicts while calling for making the country militarily and economically self-reliant on the path to speedy development.

Pledging to make India strong, the President pleaded for making national security a national priority and expressed his unflinching commitment to secularism.

71-year old Kalam, who hails from a humble boatman's family in Rameswaram, was sworn in by the Chief Justice of India B N Kirpal at a solemn and unique ceremony in the Central Hall of Parliament in which 100 children from across the country were also present.

Kalam, the third Muslim and the first Bharat Ratna to occupy the highest Constitutional office, took the oath in the name of God.

In a 10-minute speech he made just after taking over from K R Narayanan, he identified cross-border terrorism, certain internal conflicts and unemployment as challenges facing the country.

"We have become victims of political intrigue": Hindujas
New Delhi,Thursday, July 25, 2002: The Europe-based Hinduja brothers today charged the CBI with victimising them in the Rs 64 crore Bofors pay-off case without any evidence and said they have become victims of a political intrigue. "This case has serious political overtones and the valuable statutory and constitutional rights of the applicants (Hinduja brothers) have been seriously impaired, compromised and violated and the applicants have become victims of a political intrigue," the brothers submitted before Special Judge Prem Kumar through counsel Ram Jethmalani.

During arguments on Hindujas' plea for quashing of CBI chargesheet on the ground of inordinate delay in probe and trial, Jethmalani said since 1987, they had been in the eye of storm and been publicly slandered and prejudiced financially.

Due to undue delay in probe and trial, their business interests were being adversely affected and the situation was being exploited by their business rivals, he submitted.

Jethmalani cited the bidding for disinvestment in Air India from which the brothers were barred.

Hinduja brothers--Srichand, Gopichand and Prakashchand-- had sought quashing of the CBI chargesheet against them saying "delayed probe and delayed trial" in the case was violative of their fundamental right to protection of life and personal liberty which includes speedy trial.

They had held CBI responsible for the delay of over 12 years in the probe and filing of chargesheet.

At the outset of the proceedings, Jethmalani filed a rejoinder to the CBI's reply to Hindujas' plea for quashing of chargesheet denying the agency's charge that they were responsible for delaying the investigation.

AG terms media report on diffrences with Centre as baseless
New Delhi,Thursday, July 25, 2002: In an unusual practice, Attorney General Soli Sorabjee, prior to presenting his views on issues relating to minority educational institutions before an eleven-judge constitution Bench of the Supreme Court today, chose to deride a media report that there was rift between him and the Centre. "There is no question of any confrontaion with the Government of India nor any rift between the Attorney General and the Solicitor General nor any pressure by the Government as has been mischievously reported in one national daily," he said in a categorical statement in a jam-packed Chief Justice's Court.

"This is wishful thinking and wild imagining," he said in his introductory statement before the Bench comprising Chief Justice B N Kirpal, Justice G B Pattanaik, Justice V N Khare, Justice S Rajendra Babu, Justice S S M Quadri, Justice Ruma Pal, Justice S N Variva, Justice K G Balakrishnan, Justice P V Reddi, Justice Ashok Bhan and Justice Arijit pasayat.

Stating that he had appeared in the earlier round of litigations on the present issue for a party against the Centre, he said if any party had any reservations on that score on his appearance, he would not mind "at all" if he was relieved from appearing before the Bench as Attorney General.

Once all the parties to the litigation unanimously said that they had no objection to the appearance of AG, Sorabjee said "I want to make it clear that I am not appearing for or against the Government of India or any of the parties.

"I am not here to take sides but to present every side of the constitutional scenario...," he added.

Modis "concerned" over bribery allegations in XeroxModiCorp
New Delhi,Thursday, July 25, 2002: The Modis today virtually held US partner Xerox Corp responsible in the bribery scam in joint venture Xerox ModiCorp and said they were extremely concerned about allegations made against group company SpiceCorp's nominees in the joint venture. "The recent disclosures by Xerox to the SEC, USA and the subsequent submission of the relevant sections to the Indian government is something that Xerox has done pertaining to its day to day operations in India," Chairman of SpiceCorp Veena Modi told PTI here.

Xerox made a voluntary disclosure earlier this month that its Indian subsidiary Xerox ModiCorp made "improper" payments of 700,000 dollars to government officials in the year 2000 to promote business, following which the Department of Company Affairs ordered a thorough probe into the Indian venture.

In its first reaction, the Indian partner, which holds about 25 per cent stake, said "SpiceCorp is extremely concerned about the allegations being made against the SpiceCorp nominees and the Indian government. "

As part of efforts to come clean on the controversy that broke about three weeks back, Modi said "we have initiated the immediate appointment of Ernst & Young as the internal auditor of XMC. They will examine and audit the company's books, accounts and records".

SpiceCorp holds the largest 18.19 per cent "effective" stake in Xerox ModiCorp while another seven per cent is held by other associate companies, she said.

Gutkha lobby threatens to move court against ban
Zafrani Zarda and Pan Masala Association of India on Thursday strongly opposed Maharashtra government's decision to ban gutkha, alleging that the step was taken at the behest of the cigarette lobby.

Addressing reporters here, association vice-president and Manikchand group chairman Rasik Lal Dariwal threatened to move court against the government decision.

Asserting that the association was not against ban on all tobacco products per se, he said the ban should be "without any distinction".

Dariwal said that the decision as of now smacked of "step-motherly treatment against our (gutkha) industry... The decision has not only brought naivety to the forefront, but also questions the so called concern for the people of the state."

Maintaining that the gutkha industry had been coughing up a tax of Rs 2,500 crore to the state exchequer and also provided employment to two crore people ranging from farmers, to transporters, to factory workers and sellers, he said that the ban would only add to the unemployment problem.

Dariwal said that the cigarette lobby had been campaigning against the gutkha industry since the eighties as they had suffered loss owing to the popularity of guthka and pan masala.

He said that with the ban on less harmful gutkha, people would "switch over to more harmful smoking products".

Activists plan campaign against voodoo tricksters

Mumbai, July 24: ANTI-SUPERSTITION groups in the city on Wednesday cited the poor conviction rate in criminal cases against voodoo practioners as the chief reason for the mushrooming of the Baba Bangali cult in Mumbai.

Shyam Manav, national convenor of the All India Anti Superstition Committee, which has been active in the state for the last 20 years, said: ‘‘Over the years, we have exposed more than 100 such fake spiritual gurus and so-called black magic practitioners. But due to lack of substantial legal evidence, the police could manage to get convictions against only two.’’

The committee has now launched an anti-superstition campaign against Baba Bangalis in the city. In a joint operation with the Social Service Branch of the police, the committee has gathered evidence against 20 Baba Bangalis to bolster legal action against them.

While the data collected through a year-long survey by committee volunteers will be handed over to the city police, the committee has warned citizens against fake practices of over 20 such gurus. They include Baba Kamal Khan Bengali, Baba Gokuldas Bengali (Kurla west), Baba Mushtakiya Bengali (Bhandup west), Baba Bengali (Ghatkopar west), Baba Khushaal Shah (Sandhurst Road West), Baba Samani Baba Shamim Tantrik (Bora Bazaar, Fort), Baba Zafar Shah (Grant Road), Baba Hussain Miyan, Gayatri Upasak Himalayan Yogi (Dadar), Ustad Baba Raza (Bandra West), Baba Jamaal Bengali (Santacruz West), Baba Ustad Bengali, Ruhani Suleimani Shah Chiragi, (Andheri West) Baba Allauddin Bengali, Ustad Baba Musa Bengali, Baba Sultan Bengali (Borivli West), Bibi Shameer Banu and Baba Shamim Bengali (Byculla West), Baba Mansoor Bengali (Chembur West), Baba Hakim Maulana Kamaluddin Shah Chisti Kadri (Jogeshwari), Gayatri Upasak LN Jyotishi (Kalbadevi)

The committee will organise street demonstrations in the next few weeks, creating awareness on the recent cases of human sacrifice. He added, ‘‘We have demanded that the state government provide funds to set up an anti-superstition cell to spearhead a state-wide awareness campaign, and an independent cell in the police department to co-ordinate legal action with the help of NGOs and local police stations.’’

US fails to block UN vote on torture convention
United Nations,Thursday, July 25, 2002: The United States faced stiff opposition from the European Union and Latin American countries as it tried to block a draft treaty which would allow independent inspection of prisons and detention centers worldwide by international and national experts to check abuses and torture of detainees. India, China, Russia, Pakistan, Japan, Libya, Egypt and Australia, were among those who voted with the United States in the 54-member United Nations Economic and Social Council (ECOSOC) on the proposal which fell down by 15 votes to 29.

Those opposing Washington included the entire European Union and most of the Latin American, Caribbean and African nations.

After the American motion was lost, the Council approved the treaty by 35 to 8 votes with ten abstentions. China, Egypt, Australia, Cuba, Japan, Libya, Nigeria and Sudan cast negative votes. But India joined the United States, Russia, Pakistan, Bhutan, Cameroon, Ethiopia and Qatar in abstaining.

India condemned the practice of torture and asserted that importance of the Convention Against Torture could not be overemphasised. But it wanted more time to be given for negotiations on the Optional Protocol to the Convention Against Torture and said the Council should work for an instrument acceptable to the widest possible representation of UN.

Washington sought to reopen negotiations fearing that it could lead to a possibility of independent inspectors looking into prisons like the one in Guantanamo Bay Naval Base in Cuba where it is holding about 500 al Qaeda and Taliban suspects.

IOC to export $100 mn worth petro products to Sri Lanka
New Delhi,Thursday, July 25, 2002: State-run refiner Indian Oil Corporation (IOC) will export 30,000 tonnes of diesel and 10,000 tonnes of jet fuel, worth 100 million dollars, to Sri Lanka this year. IOC inked the 100 million dollar term contract with Sri Lanka's state-owned Ceylon Petroleum Corporation (Ceypetco) in Colombo today, a company statement said here.

IOC would supply 40,000 tonnes of products annually on C&F, Colombo (cost and freight) basis over a one-year period, commencing September 2002.

"The value of supplies under the term contract would be 100 million dollar at current prices," the statement said.

"This is the largest order IOC has bagged in recent times, and is in tune with our corporate vision of becoming a transnational energy major," IOC Chairman M S Ramachandran said adding the initiative would expand the company market base and convert surplus products into more wealth.

Ceypetco Chairman Daham Wimalasena and IOC Executive Director (International Trade) N K Nayyar signed the term contract in Colombo.

Sri Lanka's current demand for petroleum products stands at about 3.5 million tonnes per annum but its domestic refining capacity is constrained at about 2 million tonnes only.

Sri Lankan National Oil Company, in order to meet the deficit of petro products, had been regularly importing about 1.3 million tonnes of petroleum products through tenders.

Rupee remains firm against US dollar early today
Mumbai,Thursday, July 25, 2002: Strong dollar supplies from exporters and foreign fund inflows continued to keep the rupee firmly entrenched against the US currency early on Thursday, but trade was quiet and directionless at the Interbank Foreign Exchange market. Opening around Rs 48.68/69 per dollar, the rupee later firmed up to 48.6675/6775 in late Thursday deals, higher from Wednesday's finish of Rs 48.6850/6900.

Sustained heavy dollar supplies from exporters and inward remittances continued to give the rupee good underlying support, despite steady dollar demand from state-run banks, a forex dealer said.

A last minute rush to cover dollar positions by banks yesterday halted the rupee's early three session sharp rally, but the domestic currency was still hovering around 4-1/2 months peaks against the greenback.

In cross currency trades, the Euro was quoted at Rs 48.70/72, Pound Sterling at Rs 76.79/81 and Japanese Yen (100) at Rs 41.87/89.

BSE: Sensex opens on strong footing on fresh buying
Mumbai,Thursday, July 25, 2002: The sensex opened on a strong note and rallied further before stabilising at around 3140 level at early stages on the Bombay Stock Exchange (BSE) on Thursday on hectic buying prompted by a dramatic rebound on Wall Street on Wednesday night. Operators and retail investors which had been unloading in the past several days, made fairly heavy commitments at the initial stages in response to a strong rally in New York Stocks. The Dow Jones Industrial Average recovered by about 489 points and the Nasdaq Composite Index ended up by 61.18 points on Wednesday.

Market sources said punters, however, seemed to be still cautious and nervous, and pressed sales alternatively at higher levels.

The BSE Sensitive Index opened sharply up at 3149.18 as against Wednesday's close of 3107.48 and later rallied further to a high of 3169.96 before being quoted at 3144.32 at 10.30 am.

Domestic investors were believed to be encouraged by heavy net investments of Rs 230 crore on July 23 after making net sales of Rs 70 crore on Monday.

Heavyweighted counters like RIL, Infosys Tech, Satyam Computers, SBI, Zee Telefilms, BHEL, BSES, Grasim, HCL Tech, and ITC were quoted substantially higher.

Among the top gainers, Hinduja TMT were quoted up by 8.67 per cent, CMC Ltd by 6.86 per cent, Tata Elxsi by 5.12 per cent, Mastek by 5.12 per cent, Mas India by 4.89 per cent and Hughes Software by 4.71 per cent.

Schools fight shy, prefer to skip lessons on AIDS

Mumbai, July 24: THIS story on sex education is about schools refusing to send teachers to attend free lessons at an ongoing AIDS Prevention Education Programme (APEP) — despite repeated reminders, circulars and veiled threats of disciplinary action by the BMC.

By this May, the Brihanmumbai Municipal Corporation (BMC) pinpointed 505 civic, private and aided schools shirking from these teacher training classes, and for the strangest excuses.

‘‘One teacher did not teach because he felt students knew much more than him and that they would teach him better. Some teachers felt parents would object and they didn’t even start the programme. A principal refused to permit time for APEP, so the teacher had to take the session on Saturdays,’’ states BMC’s school health department’s report for June ’01-May ’02.

Now that 457 city schools still have no trained teachers to conduct sex and AIDS education lectures for Std IX, authorities are not surprised.

At Wednesday’s BMC workshop for 30 Marathi-medium schools, 13 teachers turned up. Sixty were expected. By noon, BMC staff was ringing up principals, telling them to dispatch two teachers each, fast. Even history, PT or Hindi teachers would do.

At M P Bhuta School, Sion, BMC medical officer Chitra Wagh was instructing her class to always ‘‘use the term husband-wife to describe sexual relations. Never say man-woman. It implies pre-marital sex as permissible.’’

UNICEF-supported APEP will conclude this August after training 1,589 city teachers since 1998. ‘‘This last batch is left-over from last year’s 505 schools which refused to send teachers. Today, despite circulars and reminders, only 13 schools have sent teachers and APEP training ends this year,’’ APEP project co-ordinator Thelma Sequira told Newsline.

As of now, 133 schools have participated in the programme, Sequira said.

Railway info on phone lines that will never be engaged

The status of your PNR number and train timings can now be accessed on phone numbers 301 7357 and 301 7358, which the Railways say will never be engaged. Started today on an experimental basis in the city, if the service proves successful, more facilities will be added. These would include call-back facility and access to information by fax or on mobile phones.

K C Jena, chief commercial manager, passenger services, Western Railway, told press persons on Wednesday that the service is being funded by Delhi-based Creative Network Technology.

Right now only PNR and train timings are available on the services, but by August end it will also give information on availability of berths. If the service becomes popular, it will inform about reservation status, real running time, delays and fare enquiry. It will also allow access to information by fax and mobile phones. There will be a call-back facility where the user can ask for information to be given at a particular time. ‘‘Suppose you have to catch a train at 3 am, the call-back facility will wake you up and tell you whether your train is on time or not,’’ said Jena.

American Airlines Allies With Swiss to start India flights
American Airlines said Tuesday it would extend its routes to five locations in Poland, India, and the Middle East beginning July 31 through an agreement with Switzerland's flagship airline, Swiss.

On Aug. 7, American said, it will sell Swiss flights with an AA code from Zurich to Mumbai and New Delhi in India.

The deal will allow American to link its flights from New York and Dallas to Zurich with Swiss flights. Swiss flies to several U.S. airports from Zurich.

Swiss was formed from the combination of regional carrier Crossair with its failed former parent, Swissair, which ceased operations and filed for bankruptcy.

Indian Author Pens Afghan Experience Despite Threat
Bombay (Reuters) - Indian novelist Susmita Banerjee is no stranger to death threats.

The scars on her face and arms tell tales of torture.

But she is determined to pen her experiences in war-ravaged Afghanistan despite warnings from its former Taliban rulers of dire consequences.

The feisty author has already written half a dozen best-selling novels in Bengali about her traumatic experiences in an impoverished village in Taliban-ruled Afghanistan for six years after she married an Afghan.

But it was after the release in February of her latest book, "Mullah Omar, Taliban O Ami" (Mullah Omar, Taliban and I), based on her personal experiences with the Taliban supremo, that she started getting anonymous phone threats.

"It is very likely the threats are coming from people closely linked to the Taliban," said Banerjee, 42, who is now escorted by two armed policemen.

"They threaten me over the phone and say I and my family will be killed if I don't stop writing."

The Taliban government was toppled by United States-led military action in Afghanistan for harboring Saudi militant Osama bin Laden ( news - web sites) and members of his al Qaeda network, blamed for the September 11 air attacks on U.S. targets.

"Her novels created a sensation among Bengali readers," said Tridip Chatterjee, who runs the Calcutta-based Patra Bharati Publishing House, adding Banerjee's books sell well in neighboring Bangladesh too, where Bengali is the main language as in West Bengal in India.

Based in the West Bengal capital of Calcutta, the author is now simultaneously writing a novel based on the people who helped her escape from the Taliban and directing a film about her life in Sarana, a village south of the Afghan capital, Kabul.

"The threats don't scare me at all. All of us have to die one day so what is the use of being scared," said Banerjee, her light brown eyes flashing with defiance.

Sipping tea in a seaside hotel in Bombay, where the writer was recording songs for her film, she could easily be mistaken for just another visitor to India's teeming financial capital.

But the two grim-faced men seated unobtrusively at a nearby table, watching over her, make a difference.

Banerjee said the government had provided two armed policemen for her security a month ago as they had information about a threat to her life.

Hindu Banerjee married Janbaz Khan, a Muslim Afghan moneylender based in Calcutta, in 1989 and accompanied him to his village in Sarana in the Pakhtia province of Afghanistan.

A year later, Khan returned to Calcutta while his wife stayed back to get better acquainted with his family.

Banerjee's travails began a couple of years later with the growing dominance of the fundamentalist Taliban, who imposed strict Islamic laws in Afghanistan, including a ban on women working outside the house and stoning to death for adultery.

After the Taliban took control of Sarana, Khan did not visit his wife fearing the fundamentalists would prevent him from returning to Calcutta.

"The Taliban wanted me to wear the burqa (veil) and convert to Islam," said Banerjee. "Because I refused they would beat me, and one day, they dragged me through the streets by my hair."

She tried twice to escape but was caught and imprisoned.

"The Taliban men said they would kill me because I had insulted Islam by not converting," said the author showing scars on her face, arms and soles of her feet, where she was repeatedly beaten with AK-47 rifles and bayonets.

Finally, with help from a sympathetic relative she fled in a vehicle to Kabul, flew to Delhi and subsequently reached Calcutta in August 1995, where she rejoined her husband.

"He first visited our home to meet me, the Hindu bride from India," said Banerjee, recalling her initial meeting over 10 years ago with Mullah Omar, who lived with his wife and children next door to her husband's uncle in Kandahar.

"Mullah Omar was soft-spoken and polite. A gentleman. But he was also a staunch Muslim, always talking about Islam," she said adding Omar's family was so poor they often went without food."

But both, Omar's fortunes and personality, underwent a dramatic change when his Taliban took over.

"He became aggressive and intolerant and asked me to convert to Islam. He was no longer the gentle "Omar mama (Omar uncle)."

England make a sedate start
London,Thursday, July 25, 2002: India were off to a decent start to the first Test, sending back both the openers as England reached 76 for two at lunch on the opening day here today. India got a wicket each towards the start and end of the morning session with skipper Nasser Hussain and Mark Butcher putting up a 71-run partnership for the second wicket in between after England had won the toss and elected to bat.

Hussain was batting on 37 while Graham Thorpe was on four at the lunch break.

Zaheer Khan, who bowled beautifully, removed opener Michael Vaughan in the second over of the innings, trapping him leg before wicket with a delivery that straightened up after pitching. England had not yet scored when the first wicket fell.

In the penultimate over before break, Kumble, who was chosen ahead of Harbhajan Singh as the only spinner in the Indian side, had Butcher caught by Wasim Jaffer at forward short leg for 29.

In between, Butcher and Hussain put up a fine partnership, surviving the initial hesitation to play free flowing shots later.

Hussain was the more forthcoming of the two batsmen and always looked to attack. He hit Agarkar for two fours in his third over and also took on Kumble, stepping out to loft him over mid-on for his fifth boundary.

Thorpe hit a four off the very first ball he faced, gliding a full-toss from Kumble through the covers.

Dear Sir,

In connection to letter of Amir Panjwani & Parent Action Committee, I feel that Indians are already divided by caste & religion. Now one more division has been created on basis of fees according to the income and medium of instruction.

It is SHAMEFUL to impose huge fees on basis of Income. Now the people have to hide their income from school authorities to save school fees beside of paying income tax.

Instead of increase in fees, the Goverment should have reduced their luxury expenses on foreign trips and improving the interiors of their Mantralay offices.

Even in recent time both the ruling party and the opposition party have made expenditures on M.L.A.s. If the same would have been utilised on Education, then free education could have been possible for next 10 years.

We should take the example of Canada & other European countries where the education is given free of charge.

If such the same policy continues then we shouldn't expect any student to become an lected President of India.
