Supreme Court issues notices to EC, state govts
New Delhi,Monday, August 26, 2002: Hearing the Presidential reference on the controversial order of the Election Commmission on Gujarat assembly poll, the Supreme Court on Monday issued notices to the Commission, all the state governments and the six recognised political parties.
A five-judge Constitution Bench comprising Chief Justice B N Kirpal, Justice V N Khare, Justice K G Balakrishnan, Justice Ashok Bhan and Justice Arijit Basayat fixed on Thursday for working out a time-table for hearing of the reference.
When Solicitor General Harish Salve, appearing for the Federal government, said under Article 174 of the Constitution, the Gujarat assembly has to be reconstituted by October two deadline, the Bench said "you don't worry about that for the time being. We will work out a time schedule for hearing of the reference on Thursday."
When certain regional political parties pleaded that they should also be given an opportunity to address the Court on the reference, the Bench refused saying "then it will be difficult to control the proceedings."
The six national political parties to whom notices were issued on Monday were Congress, BJP, CPI(M), CPI, Nationalist Congress Party and BSP.

Govt not to pressure constitutional agencies: PM
New Delhi,Monday, August 26, 2002: Prime Minister Atal Bihari Vajpayee on Monday said the Government will not bring any pressure in working of the CBI or any other constitutional agency, but asked the premier investigating body to evolve a system that can catch "the big and the small fish" by reforming the criminal justice system.
"We shall not tolerate corruption, howsoever highly placed the offender may be. The government shall not bring any kind of pressure in the working of the CBI or any other constitutional agency," Vajpayee said while inaugurating a two-day conference of the CBI and state anti-corruption bureau.
"This is not an assurance. It is a fact. It is our track record," the Prime Minister asserted.
Stating that government was committed to grant "greatest autonomy" to investigating agencies including the CBI, he asked the state governments also to provide similar autonomy to their anti-corruption agencies.
Asserting that autonomy entailed greater responsibility and higher accountability, he said "this leaves no scope for passing the buck or for putting the blame on others".

Supreme Court adjourns hearing in pump case till Wednesday
New Delhi,Monday, August 26, 2002: The Supreme Court on Monday adjourned till Wednesday hearing on the cancellation of allotment of about 3600 petrol pumps, LPG agencies and kerosene dealerships done on the Prime Minister's order of August 5 following allegations of favouritism in their award.
A bench comprising Chief Justice B N Kripal, Justice K G Balakrishnan and Justice Arijit Pasayat asked for details of 483 petrol pumps, gas agencies and kerosene dealerships which have been taken over by the state-run oil companies pursuant to the cancellation order of August 9.
The bench said "this is necessary to determine what kind of interim orders were needed to be passed in the case."
Of the 3,565 allotments made after January 1, 2000, oil companies have taken over 483 pumps and agencies while terminating 2,131 awards.
Of the 2,131 allotments cancelled, 288 petrol pumps, 541 gas agencies and 44 kerosene dealerships were commissioned while in case of the remaining, only Letters of Intent (LoI) were issued.
Of the 3,565 dealerships which have to be cancelled, 979 petrol pumps, 1,162 LPG agencies and 105 kerosene dealerships have already been commissioned while LoIs have been issued in case of 681 petrol pumps, 532 gas agencies and 106 kerosene dealerships.

Gutka users find ‘mobile’ shops

Perhaps it is difficult, but getting their hands on a packet of gutka is certainly not an impossible task for thousands of gutka addicts in the state. The Government of Maharashtra may have implemented a ban on the sale and chewing of gutka earlier this month, but those willing to fork out double the original price for a packet aren’t really missing the tobacco-based addictive.
Following the ban, the gutka sachets that vanished from paan shops are now available in a unique ‘mobile service’ in many parts of south Mumbai. This means individuals selling the product bring it on order to customers. The packets are available in Pydhonie, Mohammed Ali Road, Madanpura, Nagpada and Fort market. They are also available in Bandra, Goregoan, Dahisar and various parts of Thane.
Incidentally, Nationalist Congress Party (NCP) General Secretary (South Mumbai) Afzal Khan has asked the Commissioner of Police as well as the Food and Drug Administration (FDA) to conduct raids on stockists and black marketeers of gutka in South Mumbai.
After the ban came into effect early this month following a decision of the government exercising its powers under Section 7 (iv) of the Prevention of Food Adulteration Act, 1954, the rise in price of each sachet has been phenomenal. Goa Gutka, originally costing Re 1 per packet, now costs Rs 2.50, sachets of Manikchand costing Rs 2.50 and Rs 5 now cost Rs 4 and Rs 8 respectively. Tulsi is up to Rs 4 or Rs 5 from the original Rs 2.50, says Khan.
Police Commissioner M N Singh says, ‘‘It is the job of the FDA to conduct raids. The police have no powers to arrest or conduct raids, we can only provide help.’’ Top
Toll in Dubai building collapse rises to eight
Dubai,Monday, August 26, 2002: One more body was recovered from the debris, taking the toll in the roof collapse incident here to eight on Monday as an official said majority of the victims -- dead and injured -- may be Indians.
At least 19 were injured, five of them seriously, and six were reported missing after the roof of a power plant under construction in the the Jebel Ali industrial area, 45 kms from here, came crashing down on Sunday morning.
An official of the Indian Consulate here said majority of the victims -- dead and injured -- were Indians from Rajasthan, Punjab and the southern states, adding authorities were tightlipped and did not give any breakup of the victims' nationalities.
An inquiry has been ordered into the incident by the Dubai Power Authority, the official WAM news agency said.
This is the second major accident at a public utility site in Dubai this year. More than 20 people, including five Indians were killed in a flooding accident at the Dubai drydock, one of the world's major ship repair facilities, in March this year.

Music bridges the gap between Indian, Pak communities in UK
London,Monday, August 26, 2002: Notwithstanding the prolonged stand-off between India and Pakistan, music has once again succeeded in bringing together people with roots in the two countries, both of which share a common tradition and taste.
Artistes from both the countries held a concert Carling Apollo Hammersmith here Sunday night that received a packed audience.
After the concert, its co-producers Amir Shahzad and Shoaib Alam told PTI that they would also hold their music shows - known as Super Music Masti 2002 - at Birmingham tomorrow, Glasgow on Aug 28 and New Port, South Wales, on Aug 29. Besides, they will hold a cultural Mela at New castle on Monday.
Tahir Saki of Pakistan's famous Nexus Group, which performed at the concert, said they would use music as a medium to strive for peace and communal harmony between Indian and Pakistani communities.
"Music cuts across physical boundaries," he said, adding that songs of Lata Mangeshkar and Mohammad Rafi are very popular in Pakistan and people listen to pirated cassettes when the original ones are not available.
"There is no point in fighting over a dispute which is 50 years old," Tahir said in an oblique reference to the current stand-off between India and Pakistan over Kashmir dispute.

HC reserves order on Koirala's petition
Mumbai high court on Monday reserved order until Tuesday on a petition filed by actress Manisha Koirala, urging for a direction to the producer of the film Ek Choti Si Love Story to delete certain 'objectionable' scenes in which her duplicate had been used.
Koirala moved the high court to challenge the final version of the film on the ground that producer Shashilal Nair had committed a breach of contract.
Nair contended in an affidavit that the film was seen and approved by Koirala twice and it was at her instance that a duplicate was used in the film because she had become obese.
Koirala denied that she had become obese and said that the film contained vulgur scenes shot using her duplicate. Tha amounted to defamation and depicted falsehood besides violating her right to privacy.
Urging the court to dismiss the petition, Nair said Koirala had earlier agreed for a duplicate in objectionable scenes and hence could not demand now for cuts in the movie.
The high court, in an ad-interim order on August 14, had restrained Nair and two others from releasing the film which allegedly portrayed the actress in obscene scenes.
Koirala affirmed that she had not seen the entire film while Nair alleged that she had seen the movie twice and had indeed approved it.
According to the producer, the film revolves around a teenager who pries into the private life of the protoganist and secretly spies on her, thus seeing her in the nude.

Rupee strengthens against US currency
Mumbai,Monday, August 26, 2002: The rupee ruled distinctly firm against the US currency early on Monday backed by strong exporters' dollar sales and inward remittances accumulated over the weekend in moderately active trade at the Interbank Foreign Exchange (FOREX) market.
The domestic unit was quoted at Rs 48.5150/5250 per dollar in late morning deals, sharply higher from last Friday's finish of Rs 48.5350/5450. The rupee opened stronger at Rs 48.51/52.
Heaped up dollar supplies collected over the weekend from export proceeds and foreign fund inflows gave the rupee good underlying support but dollar demand from state-owned banks later in the day may prevent further sharp gains, a forex dealer said.
The rupee came under late pressure on Friday owing to a false alarm suggesting renewed tension on the Indo-Pak border.
In cross currency trades, the Euro was quoted at Rs.47.13/16, Pound Sterling at Rs. 73.85/88 and the Japanese Yen (100) Rs. 40.51/53.

Success tastes bitter for this Carrom champ

HAD 17-year-old Sujata Hyalinge’s achievements been in the field of cricket, she would have been a star. She may be a champion, but not many are aware that she bagged the gold medal in the women’s single and mixed doubles events at the sixth SAARC Countries Carrom Tournament in Maldives. The tournament was held in the Ghiazuddin School between August 12 and 15. This is the first international achievement for the first year Arts student of RK Talreja College in Ulhasnagar, who earlier won the Thane district championship nine times in a row and once ranked second in the state-level tournament.
Now that Sujata has been asked to represent India in the forthcoming Carrom tournament to be held in London, her father doesn’t know how to gather the cash.
‘‘The Maldives tournament cost us Rs 20,000. Acknowledging her talent, R K Talreja College donated Rs 5,000 for the trip. Friends and well-wishers came forward and helped with whatever they could and a major part was borrowed,’’ says Hyalinge. They had approached the Ulhasnagar Municipal Corporation for assistance, but his request was turned down by the municipal commissioner B R Poharkar on the grounds that it would set an unwanted precedent. The All India Carrom Federation has assured Sujata reimbursement for expenditure incurred in the Maldives tournament, but no time frame has been set for the same.
