SC rules out interference in Nov-Dec poll for Gujarat
New Delhi,Thursday, September 02, 1999: Virtually ruling out interference with the Election Commission's decision to hold polls in Gujarat in November-December, the Supreme Court today expressed its inability to give its opinion on the Presidential reference on this issue by the October deadline for reconstitution of the Assembly.
After the Commission specifically informed the Court that it will hold polls in November-December, a five-Judge Constitution Bench headed by Chief Justice B N Kirpal said "Perhaps November-December is most likely date for holding polls. So, Gujarat is not an issue before us."
Separating the issues raised in Presidential Reference on the controversy over the Election Commission's power under Article 324 and the mandatory sitting of the Assembly every six months under Article 174 from the holding of polls in Gujarat, the Bench said "We do not think it will be possible for us to say that it will be incorrect to say holding of polls in November-December will be wrong."
While posting further hearing on the Reference to September 17 and asking all parties to complete pleadings by then, the Bench issued notices to the Centre, Gujarat Government and Chief Minister Narendra Modi on a PIL which raised a question that under the Constitution there was no provision for a caretaker Chief Minister.

Gujarat heading for brief spell of President's rule
With the Supreme Court declining to interfere with the Election Commission's plans to hold Assembly polls in Gujarat in November-December, the state appears to be headed for a brief spell of President's rule.
This appears inevitable as the new Assembly may not be in place by October two deadline when the six-month gap between two of its sittings expires. According to the Constitution, the maximum period between two sittings of an Assembly should not be more than six months.
In its observations today on the reference, the Court voiced its inability to give its opinion on the Presidential reference immediately.
On the plea of Solicitor General Harish Salve for early hearing of the reference, the Bench headed by Chief Justice B N Kirpal said "however, if you think a decision can be given by October two, it is impossible for all practical purposes."
Reacting to the Court decision, Law Minister Jana Krishnamurthy said it was "not (not) altogether unexpected".
The BJP dismissed perception that the Court decision was a setback to it. "I don't think there is any such issue for us to make presumptions either way," he said, reconciling to the possibility that the elections may not be held before October.

BSF deploys 36 companies in Rajouri-Poonch
Jammu,Thursday, September 02, 1999: The Border Security Force (BSF) has deployed 36 companies in Rajouri and Poonch districts, which go to polls in the first phase of elections in Jammu and Kashmir on September 16, a BSF spokesman said.
"We have deployed 36 companies comprising of 3600 personnel for the first phase of polling in Rajouri and Poonch border districts on 16 September," the spokesman told PTI here today.
Bordering Pakistan occupied Kashmir (POK), Rajouri-Poonch belt in south of Pir Panjal range is considered as operational hub of militants and poses a challenge to the security forces for holding trouble free elections, he said.
There are over 600 polling stations declared as hyper-sensitve and sensitive in the belt, which will be manned besides providing security to polling staff.
The BSF is currently engaged in sanitisation and area dominations in difficult and mountainous terrains of the belt, the spokesman said.
Besides BSF, CRPF, Railway Protection Force (RPF), Punjab Armed Police and local police have been deployed in the areas for the elections, he said.

Sept 11 plotters may be planning more strikes: investigators
New York,Thursday, September 02, 1999: Investigators who have spent months trying to unravel the plot that resulted in the Sept 11 attacks are reportedly worried about key figures in the conspiracy who got way, including radical 'jihadi' Khaled Shaikh Mohammad and at least three other men who have only identified as the planners and financiers of the attacks.
The investigators believe they are in hiding and may be planning future strikes.
"The danger is very real," one CIA official told 'Newsweek'. "September 11 demonstrated to us that you don't need a large number of people or a huge infrastructure to do a lot of damage.
"There are still a lot of people out there who can do some real harm," he told the magazine.
And investigators have reason to believe that Mohammad is not only alive but hard at work, 'Newsweek' said.
US officials were quoted as saying they have evidence linking Mohammad to the April bombing of a Tunisian synagogue which killed 21 people. The suicide bomber phoned Mohammad just three hours before detonating himself, they said.
The magazine quoted an unidentified senior official as saying that US intelligence believes Mohammad had a powerful collaborator in planning the strike: Saad bin Laden, one of Osama's sons.
Agents didn't realize just how important Mohammad was in planning the September 11 attacks until April, when they captured Abu Zubaydah, the suspected Qaeda operations chief.
Inside Zubaydah's safe house, they discovered a large cache of information about the plot and sources said Zubaydah himself confirmed to investigators that Mohammad was one of the key Sept 11 conspirators.

Indian school girl stabbed to death in South Africa
Durban,Thursday, September 02, 1999: A 14-year-old school girl of Indian origin has become the latest victim of brutal attacks against the community sweeping the city.
The victim identified as Lovisha Persad of Reservoir Hills suburbs was stabbed in a park during the weekened. She had almost 40 stab wounds on her body, police said.
She was sent by her parents to the local shop on an errand when the incident took place, Police superintendent Glen Nayager said, adding the young girl was abducted while she was returning home from the shop.
"We do not suspect robbery as a motive for the killing as she was still wearing a gold chain and a wrist watch when her body was found," he said.
The latest murder has taken the number of people of Indian origin killed in the area over the past two months to 20.
The incident follows the murder of three friends by hijackers in the township of Chatsworth in Durban last week. Clive Pillay, Louis Govender and Sandy Pillay were beaten up, stabbed and shot dead after a meeting outside a cricket stadium in the predominantly Indian working class township.
In another gruesome incident a day after the murder of the three men, police found the headless body of Colin Govender in a rural area near here.
Last month two elderly women were strangled to death in their homes by burglars while a third woman was shot dead in her shop by an assailant.
Indians have become a target of attack in South Africa after musician and playwright Mbongeni Ngema released an anti-Indian song accusing the community of exploiting and oppressing black Africans.

NE extremists not to be allowed to function from Bangladesh
Silchar (Assam),Thursday, September 02, 1999: Bangladesh High Commissioner to India T K Haider has assured that the extremist groups of North East will not be allowed to function from his country.
"The extremists will not be allowed even an inch of land in Bangladesh from where they can function against the interests of India," Haider told reporters here Sunday.
"Bangladesh values its close relations with India and at no cost will that be allowed to be jeopardised", he said.
Haider said there may be certain areas of differences between the two countries but these can be sorted out through dialogue and mutual understanding.
He also highlighted the scope of increasing the volume of business between the two countries.
Haider was here for a joint inspection of the point of bifurcation of Barak river into Surama and Kushiyara at Bhanga BSF outpost to ensure equitable distribution of water.

Turkey, Iran reject military solution to Iraq issue
Dubai,Thursday, September 02, 1999: Turkey and Iran have rejected a military option for the change of government in Iraq saying the crisis has to be settled peacefully after consultations with countries in the region.
"Any change in the Iraqi government must come from the people of that country," Turkish Foreign Minister Sukru Sina Gurel said in a meeting with his Iranian counterpart Kamal Kharrazi, a media report said.
Gurel's statements were echoed by Kharrazi who also called for consultations among regional countries on the issue
to prevent a major crisis. "The Iraqi regime is unpredictable. It has caused a lot of damage to the region with its incursions in the past two decades. Despite this, no foreign country has the right to
interfere in that country's affairs," he said.
Consultations among Iraq's neighbours are key to preventing insecurity in the region, Kharrazi said, adding any development in Iraq affects its neighbours and the region. "Exchange of views among neighbours to examine strategies to (exhort) Iraqi cooperation with the United Nations is an effective step to averting a major regional crisis," he was quoted as saying by the official Iranian news agency IRNA. Gurel is on a two-day visit to Tehran since Saturday to discuss bilateral ties as well as regional and international issues with Iranian officials. His visit follows Turkish President Ahmet Necdet Sezer's trip to Iran in June.

SC threatens exemplary costs against Pepsi and Coke
New Delhi,Thursday, September 02, 1999: Indicating that it would impose "exemplary costs" on cola majors, Pepsi and Coca Cola, the Supreme Court today appointed a committee to go into the damage caused to the environment by painting of advertisements on the rock faces of eco-fragile Himalayas on Manali-Rohtang road in Himachal Pradesh.
Hearing an application on the issue filed by Solicitor General Harish Salve, a three-judge Bench comprising Chief Justice B N Kirpal, Justice K G Balakrishnan and Justice Arijit Pasayat said, "we are going to impose exemplary costs on those who cause environment pollution by painting rock faces."
Asking the two cola giants to deposit Rs 50,000 each within three days for the costs of inspection of the ecological damages by the painting of advertisements, the Bench said the two companies could depute their representatives to accompany the Committee, which was given 10 days' time to submit a report to the Court.
Referring to the widespread painting of advertisements on the rocks, the Bench said "not only Pepsi and Coca Cola but it has been free for all to resort to this type of advertisements."
"So, we are very keen that remedial steps are taken," the Court said while sounding a warning that "we are going to stop all such kinds of activities".

Minor swap in commerce ministry
New Delhi,Thursday, September 02, 1999: Government today decided to swap the positions of two senior officials in the Department of Commerce.
While Vinay Bansal, earlier approved as Additional Secretary and Financial Advisor in the Department of Commerce would be Additional Secretary in the Department, A N Tiwari, earlier approved as Additional Secretary would be Additional Secretary and Financial Advisor in the Department of Commerce.
This was decided by the Appointments Committee of the Cabinet, says a release.

BSNL announces countrywide cellular
New Delhi,Thursday, September 02, 1999: State-owned Bharat Sanchar Nigam Limited today announced its country-wide cellular mobile services under the brand name "CellOne" and the services are expected to be operational by October two.
The announcement was made by Union Communication and IT Minister Pramod Mahajan at an event which marks the completion of his one year in the communication ministry.
BSNL also launched its pre-paid cellular services called "ex-cel". The services would be available in 350 cities by October two. "All state capitals will be linked with the CellOne by this Gandhi Jayanti and by Christmas 830 more cities would be connected through this," he said.
And by March 2003, all district headquarters would be covered under the services, Mahajan said adding the beauty of the public sector was that decisions were not based on "business cases but on need basis".
Today also saw the launch of internet telephony to be called "WebFone" would reduce the cost of international long distance communication (ISD) significantly.
Asked about the tariffs of BSNL's cellular services, Mahajan said these were being worked out and would be announced soon.

I have nothing to lose in playing for the country: Robin
India Under-19 coach Robin Singh said he was ready to take up the job of leading the country in the forthcoming ICC Champions Trophy in Sri Lanka from Sep 12.
"I am not thinking about it (captaining the team) at all. My job was to coach under-19 boys. However, if I am given a job to lead or play for the country, I will definitely take it up because it is the biggest honour for me," Robin Singh said on his arrival from England after he guided the Indian U-19 team to a one-day series win last week.
"And if you really think seriously, I have nothing to lose by playing for my country," he added.
The Indian Cricket Board announced a 25-member fresh probables's list for the Champions trophy after top cricketers, currently playing a Test series in England, refused to sign the ICC contracts.
The dispute is yet to be resolved after the ICC decided to give more time to the Indian players to sign the contracts after a crucial meeting of the Test playing nations in Dubai.
"I still have a couple of years left in me and I am not quitting as a cricketer," Robin Singh said.
