[nukkad] PIL

A friend asked me whether a PIL can be filed against railways. I 
answered in the negative. His letter and my reply are given below 
for inviting any comments from list members.

Dear Krishnanji,

PIL can be filed if the railways are not doing something as per 
rules or if they have not made rules which they should have made. 
It does not appear they are violating any rules at present.

As regards making it a rule that all compartments should have 
waste baskets, this does not appear to be a practical feasibility 
because, then, we will need baskets, men to collect trash, and 
facilities to transport the trash from railway stattion to trash 
disposal site and facilities for such disposal. You know that even 
municipal waste disposal is inefficient at present.

Then, there is the question of alternatives and precedents. Are 
there railways in countries with long distance trains and Indian 
conditions which are having the system suggested by you? I do not 
think so.

In summary, I do not think a good case can be made out for a PIL 
on this issue.

Sorry for this late reply. If you remember i had enquired about a 
PIL against the Railways.
Simply put, the Railways do not rpovide proper wastage disposal on 
the trains. The second class compartmenst do not have waste apper 
baskets leading to the passengers disposing of any waste on the 
tracks. Even in the AC coaches the baskets are few in no: and also 
the emptying of the baskets are done onto the tracks.
Thus, cannot this be shown as environemntal hazard? Is it 
possible?
