You go wrong here. I was a prime witness in a monetary litigation filed by
one muslim against another. Since I prepared the whole case submissions, my
witness held the key to the whole case.
The plaintiff and the defendants were both Arabs, palestinian muslims. The
jurisdiction was Abudhabi and hence the case was heard in Abu dhabi sharia
court. The sum involved was $175,000/-. Minor witnesses, in all two, were
given hearings, who both were Indian Christians, one a Manglorean ( he still
works with me) and the other Tamil. Their explanation in the court did not
do much good to the case, for they both had little role in the case matter.
When my turn came in the hearing, all hopes were hinged on me. The
prosecution lawyer pointed out to the judge (Qazi) that I was neither a
Muslim nor a person belonging to the faiths mentioned in the Book and hence
I could not be expected to swear by Quran or Bible or Torah and hence he did
not believe I could speak the truth.
To help my boss who was the complinant, I also went to the extent to say
that although I am Hindu, I was prepared to swear by Quran, if that was
acceptable. But on hearing this request of mine from the official
translator, the judge made faces which I haven't yet forgotten and thus I
was not allowed by the court to give evidence, proof or any explanation of
any kind whatsoever.
Within minutes, then the case was over and our boss lost his rightful money,
while I felt indignation.
The plaintiff was Sun Engineering, the defendant was architect Hisham
Hussaini, jurisdiction was the Emirate of Abudhabi and the court was
Abudhabi Sharia. The year was 1986 or there about.
Your explanation is not valid in a case when both the sides at dispute are
Muslims and the case is in Sharia court and the witness happens to be
non-Muslim, non-christian, non-Jew.
Hope you will do good homework and abhor writing something which misleads
members, most of whom are not from this region.
