Scott,

I agree 100% with your assessment. If it is a choice
of Life in prison (even with no possibility of parole)
as it stands TODAY - I think killing the perpetrator
is a better punishment.

As it is today, Life in Prison is just a little worse
than living in a half-way decent motel. I am sure
there are millions of Americans (and tens of millions
of Indians) that live in worse conditions with no
guarantee of their next meal. It is hardly
classifiable as a 'ounishment'. It is more like a rap
on the knuckles - 'Naughty naughty boy. Don't go about
killing 168 people again. And to make sure that you
don't we are going to keep you comfortable without a
worry for the rest of your life - spending more than
TWICE the poverty line annual income to keep you alive'.

No - in such cases death is preferable.

However if Scott's vision of life in prison is
actually viable (fancy the ACLU allowing that to
happen) I would certainly plumb for that one. And
while they are prisoners they should be FORCED to work
for their living. Just like in the Hindi movies, the
prisoners are shown using sledge hammers to break
rocks - the present days prisoners should be FORCED to
work for their ENFORCED living. And the rest of their
time should be in solitary confinement - as close to a
living hell as possible.
