The words "This incident will prove to be a final nail in coffin for our Congress Govt" bring to mind the words of Pandit Madan Mohan Malaviya, founder of BHU, when he was leading the protest against the Simon Commission: "Every blow on my head is like another nail in the coffin of the British Empire". 2. The above are brave words. What is the proper strategy .to achieve the desired result, which is, withdrawal of the provision for reservations for OBC? 3. In the present political scenario, where the Constitutional Amendment for reservations for OBC was passed by near unanimity, it would be foolhardy to suppose MPs would vote to undo what they have done unanimously. 4. The way out lies in the fact that the Amendment nowhere talks about ONE, the quantum of such reservation being 27.5% or, even, proportionate to the population strength of OBCs; TWO, it being applicable to ALL OBCs, meaning thereby that creamy layers ned to be kept out; THREE, it being applicable UNIFORMLY in all situations. For example, there is no reservation for HC and SC judges and the Armed Forces. 5. Supreme Court has already held that reservations shall not be more than 50%. What is sought to be done by Arjun Singh is to fill the gap between 27.5 [15%+7.5% for SC/ST] and 50% by allocating the entire amount to OBCs, thereby effectively precluding the possibility of giving any reservation to others, such as the poor/economically backward]. 6. The Amendment has to be followed by executive orders providing for reservations for OBC. The anti-reservation struggle has come up at the right time, before such orders have been promulgated. 7. The protesting medicos should withdraw their demand for roll back of the Amendment. Chances are bleak. They would earn much opposition to it. Pro-reservationist movement has already started. This will fritter the stamina of medicos. Moreover, they would soon lose public support due to continued denial of patient care. 8. SUGGESTED STRATEGY-- A. Persist with the demand for judicial commission to review the reservation system in the past and to withold implementation of the Amendment till the report of the Commissionn is out; B. Insist on exclusion of creamy layer among OBC; C. Insist on inclusion of reservations for the economically backward. Let them suggest that of the 27.5% gap [proposed to be filled up by granting 27.5% reservation to OBC], let 9% be given to OBC and 9% to the economically backward, taking the reservation block to 40%, leaving the 60% for general categories. D. Let them suggest an alternative formula for determination of reservation on the basis of a clearly identifiable point system in respect of the 40% reservation block, as follows: i. Reservation should be for those with low socio-economic status; ii. Criteria for low SES are well known as per standard public health and sociology textbooks. The accepted SES scale used in India for last 40-50 years recognizes three criteria for determining SES--Education of Head of household or HHH; Income expressed as per capita family income; caste. All these three can be easily graded on a point system, as follows: Education of HHH--1 [illiterate as per govt. definition of illiterate], 2 [Below class 10]; 3 [Above class 10 passed] Income--1 [BPL, Below Poverty Line, as defined by Govt].; 2, [Non-income tax payers; 3 [Income tax payers] Caste--1, SC; 2, ST; 3, OBC Those with lowest SES should get preferential reservation. This would mean that the differential quotas for different categories would be abolished and only those would be permitted to apply out of this quota who are below a certain SES score, which can be easily calculated on an individual applicant basis. 9. CAUTION--The suggestion for SES system should not be made now but should be the suggestion to be given to the proposed Commission mentioned above. NOTE-- Hope this mail, if readers find it worthwhile, would be circulated widely and taken note of those who are spearheading this agitation, including the AIIMS Students Union.
