In the instant case, suppose the marriage was terminated by  divorce....
WTF does divorce enter the picture?

 ATTORNEY: Can you describe the individual?
 WITNESS: HE was about medium height and had a beard.
The last time I looked up my English grammar He referred to the male
of the species...and if he answered female the only thing that
crumbles is his command of the English language!

" Suppose the witness answers to the question: It was a female. The whole
 witness evidence crumbes!"

And now I am convinced why I did not pursue a career in law....
But then again only MCG can come up with such a response
