You are right - but the telemarketers don't see it that way. 
They claim that the law passed by the US federal govt violates
their free speech rights that are promised to them by the US
constitution.

The first amendment to the US constitution reads: 

   Congress shall make no law respecting an establishment of religion, or 
   prohibiting the free exercise thereof; or abridging the freedom of speech, 
   or of the press; or the right of the people peaceably to assemble, and 
   to petition the government for a redress of grievances.

Note that there is no mention of only 'good' speech being allowed.
All speech is protected and this is what the telemarketers are
using to argue their case. 

Previous court cases have determined that 'commercial speech' does
not deserve the same protection as 'non-commercial speech' but this
is not yet widely accepted. Hence the court case.
