If this were to happen on Usenet - how would it work? Or - if this were on an automated NON moderated listserv how would it work? 

Simple - the e-mails would get published.

Your policy of moderation does NOT have anything to do with content itself. I am not sure what the precise policy is and am also not sure if there is a place where you have written up your moderation policy (maybe you should do so now - what?). But if someone chooses to forward an e-mail to a Usenet discussion group, there is nothing to be done! It gets published!

I think you should stay 'hands-off' for this and publish everything that does not conform to your PUBLISHED rules of moderation. Thus if your rules state that you will NOT forward personal e-mails howsoever deeply nested they may be, then you will have to stick with it regardless of the trouble that causes. 

My personal recommendation: Publish the e-mails. Your moderation is strictly for length of e-mail, length of content from prior e-mails etc. Don't get into the content business. Let the two duke it out. If someone sent in a private e-mail as a response to something sent to the list and a replier wants to bring it BACK to the list - so be it. Personal or not - once you have started to talk about things in public - there is no privacy.
